VACATION RENTAL AGREEMENT Please read this agreement carefully before beginning your stay. 12385 Sorrento Road, Unit A4 | Pensacola, FL 32507 info@lunasolvcations.com | (850) 791-3095 This Agreement (the "Agreement") is made by and between Perdido Key Rentals Management Inc., operating under the DBA LunaSol Vacations ("Agent"), and the undersigned ("Guest") as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties agree as follows: We will notify you via text message when your vacation home is ready for check-in. Please ensure we have your current cell phone number on file for seamless communication. 1. PROPERTY Amenities Provided: Bath linens, bed linens, a fully equipped kitchen with basic essentials, and a washer and dryer. What to Bring: Beach towels, beach toys, beach equipment, extra paper products, additional trash bags, and spices you may need. A starter set of paper towels, toilet paper, trash bags, laundry detergent, dishwasher pods, and soaps is provided for your convenience. Note: Each property is privately owned. Furnishings and decor reflect the individual tastes of the owner and are subject to change without notice. 2. MAXIMUM OCCUPANCY Occupancy Limit: All properties are limited to the actual sleeping capacity shown on the listing. Exceeding the stated occupancy limit is a material breach of this Agreement and will result in immediate termination of the rental without refund. Age Requirement: The primary Guest must be at least 25 years of age to rent. Valid government-issued photo identification must be provided upon request. Prohibited Activities: Sororities, fraternities, house parties, and weddings are strictly prohibited. False Pretenses: Reservations made under false pretenses may result in immediate eviction and forfeiture of all rent paid without recourse. 3. GUEST IDENTIFICATION REQUIREMENTS Guest identity verification is required for all reservations. The following applies based on how the reservation was booked. Direct Bookings (LunaSol Website, Phone, or Email): Guests who book directly through LunaSol Vacations are required to submit a valid government-issued photo ID prior to arrival. Acceptable forms of identification include a state-issued driver's license, state ID card, or passport. Photo ID must be submitted electronically to info@lunasolvcations.com or through the LunaSol Vacations guest portal no later than 48 hours before the scheduled check-in time. Failure to provide valid identification prior to arrival may result in denial of access to the property without refund. OTA Bookings (Airbnb, VRBO, and Other Online Travel Agencies): Reservations made through Airbnb, VRBO, or other online travel agencies (OTAs) that maintain their own identity verification systems may be exempt from the LunaSol direct-submission requirement, provided the Guest's identity has been verified through the OTA's platform prior to booking. LunaSol Vacations reserves the right to request supplemental identification from any Guest at any time, regardless of booking platform, if identity cannot be confirmed. Guests booking through OTAs remain subject to all other terms of this Agreement. 4. LEASE TERMS Check-In: 4:00 p.m. on the check-in date. Early check-in is not guaranteed and is subject to availability upon request. Check-Out: 10:00 a.m. on the check-out date. Guests who have not vacated the property by 10:00 a.m. on the check-out date without prior written approval from LunaSol Vacations may be charged a late check-out fee of $100 per hour or any portion thereof, charged to the credit card on file. 5. ACCESS The Agent reserves the right to access the property for repairs, inspections, or emergencies. Access will be coordinated reasonably to minimize inconvenience to Guest. If the property is listed for sale, the Agent may schedule showings with reasonable advance notice to the Guest. 6. RENTAL RATE AND PAYMENT TERMS Payment Schedule: A deposit of 25% of the total rental cost is due at the time of booking to confirm your reservation. The remaining balance is due in full 45 days prior to the arrival date and will be automatically charged to the credit card on file unless alternative payment arrangements have been approved in writing by LunaSol Vacations in advance. Reservations made within 45 days of the arrival date require payment in full at the time of booking. If the remaining balance is not received 45 days prior to arrival, LunaSol Vacations may treat the reservation as canceled and retain the 25% deposit as liquidated damages. Accepted Payment Methods: Credit and debit cards (VISA, MasterCard, Discover, and American Express) are accepted. Checks are accepted only when received at least 45 days prior to arrival. Cash is accepted in person only. All applicable state and local taxes are subject to change without notice. The tax amount shown at booking may not reflect subsequent rate increases, which Guest agrees to pay if applicable. 7. CANCELLATION POLICY IMPORTANT NOTICE REGARDING OTA BOOKINGS: If you booked your reservation through a third-party platform such as VRBO, Airbnb, or another online travel agency, your cancellation policy is governed by the terms of that platform and may differ materially from the LunaSol Vacations direct-booking cancellation policy set forth below. Please refer to your booking confirmation for the applicable cancellation policy. If you are unable to locate your cancellation policy or are uncertain which terms apply, contact LunaSol Vacations before submitting a cancellation request at info@lunasolvcations.com or (850) 000-0000. LunaSol Vacations Direct-Booking Cancellation Policy: The following terms apply exclusively to reservations made directly through LunaSol Vacations. For Condominiums, cancellation must be submitted at least 30 days prior to arrival to receive a refund minus a 4% cancellation fee. For House Rentals, cancellation must be submitted at least 60 days prior to arrival to receive a refund minus a 4% cancellation fee. For Monthly Rentals, cancellation must be submitted at least 90 days prior to arrival to receive a refund minus a 4% cancellation fee. Cancellations submitted outside the applicable notice period will result in forfeiture of the advance deposit in full to the property owner. No refund will be issued. Reservation processing fees, the $75 damage waiver fee, and any travel insurance costs are non-refundable regardless of when a cancellation is submitted. All cancellations and modification requests must be submitted in writing to info@lunasolvcations.com. Verbal cancellations will not be honored. 8. DAMAGE WAIVER PROGRAM A non-refundable Damage Waiver Fee of $75.00 is required for every reservation without exception. This fee is charged at the time of booking and applied toward LunaSol Vacations' damage protection program administered through Guesty, which provides coverage for accidental, unintentional damage to the interior of the rental property up to $1,500.00 per reservation. Coverage Conditions: Damage must be reported to LunaSol Vacations immediately upon occurrence and no later than at the time of Guest check-out to be eligible for waiver coverage. Guest must cooperate with any damage assessment process required by LunaSol Vacations or its program administrators. Coverage applies only to accidental, unintentional damage to the interior of the property occurring during the confirmed reservation dates. Exclusions: The following are not covered by the Damage Waiver: damage caused by smoking or vaping anywhere on the premises; damage caused by pets, whether authorized or unauthorized; intentional damage or vandalism of any kind; unauthorized access to or damage within the Owner's private storage area; damage requiring excessive cleaning beyond normal use; and damage to personal belongings or items brought to the property by the Guest. Any intentional damages or damages exceeding the $1,500 waiver limit will be charged directly to the credit card on file. By executing this Agreement, Guest expressly authorizes LunaSol Vacations to charge the credit card on file for any such amounts. 9. INTERNET AND CELL SERVICE Most properties offer courtesy high-speed Wi-Fi. LunaSol Vacations cannot guarantee internet service and will not issue refunds for outages or slowdowns. Guests for whom internet access is critical are advised to bring a personal mobile hotspot as a backup. Cell phone reception in certain areas, including gated communities and certain condominium complexes, may be limited or unreliable. No refunds will be issued for poor reception. 10. ADVERTISEMENTS AND PROPERTY AVAILABILITY LunaSol Vacations makes every effort to ensure property information is accurate; however, information is subject to change without notice. LunaSol Vacations is not responsible for errors, omissions, or changes made by property owners. Some properties include amenities such as cargo lifts that are restricted to owner use only — Guests are not permitted to use such amenities. If a reserved property becomes unavailable due to unforeseen circumstances, LunaSol Vacations will notify Guest immediately and make reasonable efforts to provide comparable alternative accommodations. 11. RENTAL RULES Guest agrees to abide by all rules set forth in this Section and shall ensure that all members of the rental party and permitted guests comply at all times. Smoking: Smoking, vaping, and use of e-cigarettes are strictly prohibited anywhere on the premises, including balconies, patios, and any exterior areas of the property. Any evidence of smoking will result in a minimum $500.00 penalty charged to the credit card on file. Liability: All properties are privately owned. Property owners and LunaSol Vacations are not responsible for any accidents, injuries, or illnesses that occur on the premises or its facilities. The Agent is not liable for the loss of personal belongings or valuables of any kind. By accepting this reservation, all guests assume the risk of harm arising from the use of the property, including harm to persons they invite onto the premises. Property Care: Guests must keep the property and all furnishings in good condition throughout the stay. Rearranging furniture or removing any items from the property is prohibited. The use of inflatable pools is not permitted on the property or its balconies due to HOA regulations and liability restrictions. Appliances must be used only for their intended purposes. Prohibited Vehicles: Motorhomes, travel trailers, and electric golf cart hookups are not permitted on the property. Pets: Pets are permitted only in designated pet-friendly units and only with prior written approval from LunaSol Vacations. Guests must complete the Pet Addendum and pay the applicable pet fee prior to arrival. Unauthorized pets will result in a $500.00 fine per pet, charged to the credit card on file. Service animals as defined under the Americans with Disabilities Act are not considered pets and are exempt from these restrictions. For questions regarding a property's pet policy, contact LunaSol Vacations directly. Occupancy Compliance: The number of guests present on the property at any time must not exceed the maximum occupancy stated on the listing. Violation is grounds for immediate termination of the rental without refund. Guests are responsible for the conduct of all persons in their party and any visitors admitted to the property during their stay. Beach Etiquette: Stay off sand dunes. Sand dunes are protected under Florida law and play a critical role in protecting the coastline. All exterior lights must be turned off during Sea Turtle nesting season (May through October). Violations of Florida sea turtle lighting ordinances may result in citations against the property and associated charges to Guest. All holes dug on the beach must be filled prior to leaving. All beach equipment and trash must be removed from the beach and property prior to departure. Housekeeping: Daily housekeeping service is not included. Linens and bath towels are included with your rental but must remain on the property at all times. Guests should bring their own beach towels. Excessive cleaning required after Guest departure beyond normal use will result in an additional cleaning fee charged to the credit card on file. 12. STORM POLICY Guest safety is a priority for LunaSol Vacations. If a named hurricane or tropical storm is projected to impact the Florida Gulf Coast, including Perdido Key or Pensacola Beach, and a mandatory evacuation order is issued by Escambia County or Santa Rosa County Emergency Management during Guest's confirmed stay, Guest may elect either a full refund of the unused portion of the stay or a reschedule to a future available date at no additional rebooking fee. Refunds for weather events are available only when a mandatory evacuation order is formally issued by Escambia County or Santa Rosa County Emergency Management for the area in which the property is located. Voluntary evacuation orders and general inclement weather do not qualify for refund or rebooking under this policy. Only the unused portion of the stay, calculated from the date and time of the mandatory evacuation order, is eligible for refund. Any portion of the stay completed prior to the evacuation order is non-refundable. Any portion of the stay following the lifting of the mandatory evacuation order is not eligible for refund or cancellation. 13. POOL, HOT TUB, AND SPA USE This section applies only to properties that include a pool, hot tub, or spa as listed amenities. If the reserved property does not include these amenities, this section is for informational purposes only. General Requirements: Any reservation at a property that includes a pool, hot tub, or spa requires acknowledgment of the Recreational Amenities Waiver and Release of Liability set forth in Section 16 of this Agreement by all adults (18 years of age and older) staying on the premises prior to arrival. Access to pool facilities will not be permitted until this requirement has been satisfied. Swim diapers are required for small children using the pool, and any accidents must be reported to LunaSol Vacations immediately. No diving, running, or roughhousing is permitted in or around the pool area. No glass containers are permitted in or around the pool or hot tub area. Guests must shower before entering the pool or hot tub. Children must be supervised by a responsible adult at all times while in or near the pool or hot tub. Pool hours are subject to any HOA or property-specific restrictions posted on-site. Unauthorized guests not included in the confirmed occupancy are not permitted to use pool or hot tub facilities. Pool Heating: Pool heaters are designed to maintain heat in cool to moderate temperatures and may not perform adequately during periods of extremely cold weather. Pool heating is an optional service and may incur an additional fee where available. Hot Tub Rules: Do not use the hot tub as a bathroom. Any unsanitary use will result in a fine of up to $200.00 charged to the credit card on file. Upon check-out, the hot tub must be left clean, full of water, and set to 104 degrees Fahrenheit. Do not add soaps, bath products, oils, or any foreign substances to the hot tub water. Do not adjust, tamper with, or disable the hot tub's filtration, heating, or chemical systems. Children under 12 years of age are not recommended to use the hot tub. Guests with certain medical conditions — including heart disease, high blood pressure, or pregnancy — should consult a physician prior to use. A maximum continuous soak time of 15 minutes is recommended. Hot Tub Availability: Hot tub functionality is not guaranteed. LunaSol Vacations will make every reasonable effort to ensure the hot tub is clean, operational, and properly maintained prior to and during Guest's stay. However, hot tubs are mechanical equipment subject to unexpected malfunctions, required maintenance, or weather-related performance limitations that may arise without advance notice. In the event of a hot tub malfunction, LunaSol Vacations will make commercially reasonable efforts to repair or service the unit as promptly as possible. No refund or compensation will be issued solely due to hot tub unavailability unless hot tub functionality was expressly guaranteed at the time of booking. Guest acknowledges this limitation and agrees not to hold LunaSol Vacations or the property owner liable for hot tub downtime during the reservation period. Pool and Hot Tub Penalties: The following violations will result in charges to the credit card on file: hot tub left unsanitary or used as a bathroom, up to $200.00; hot tub not left full and set to 104 degrees Fahrenheit at checkout, cleaning and service fee as assessed; glass containers in the pool or hot tub area, up to $200.00; tampering with pool or hot tub equipment, repair costs up to $500.00; unauthorized guests using pool or hot tub facilities, up to $500.00 and grounds for immediate termination of the rental without refund; exceeding pool occupancy, up to $500.00 and grounds for immediate termination of the rental without refund. 14. INDEMNIFICATION AND HOLD HARMLESS While property owners strive to maintain vacation properties in excellent condition, no guarantees are expressed or implied regarding the suitability of any property for any particular purpose. All guests and their invitees use the property entirely at their own risk. Neither LunaSol Vacations nor the property owners shall be held liable for injuries or damages resulting from intentional or unintentional acts of guests or their invitees; failures or malfunctions of structures, appliances, furnishings, or equipment; acts of nature, allergens, mold, or chemical agents; or any other cause arising from or related to Guest's use or occupancy of the property. Guest and all members of the rental party agree to indemnify, defend, and hold LunaSol Vacations and the property owners harmless from and against all claims, demands, losses, costs, and liabilities, including the cost of legal defense, arising out of or related to Guest's use or occupancy of the property. 15. COMMUNICATION CONSENT By completing this booking, Guest authorizes LunaSol Vacations to send transactional text messages and emails regarding the reservation and related service communications. Standard message and data rates may apply. Guest's consent to receive marketing communications is not a condition of purchase. 16. RECREATIONAL AMENITIES — WAIVER AND RELEASE OF LIABILITY This section applies exclusively to properties that include one or more of the following amenities as listed at the time of booking: swimming pool, hot tub, spa, kayaks, or bicycles. If the reserved property does not include these amenities, acknowledgment of this section is not required. A. General Release of Liability — All Recreational Amenities Guest acknowledges and agrees that all recreational amenities are used entirely at Guest's own risk. Neither LunaSol Vacations nor the property owner makes any warranty, express or implied, as to the safety, condition, or fitness of any amenity for a particular purpose. LunaSol Vacations and the property owner shall not be liable for any injury, illness, accident, death, property damage, or loss of any kind arising from or related to Guest's use of any recreational amenity, including those caused by equipment failure, defect, or condition of the amenity. Guest assumes full responsibility for supervising all members of their party, including minors, while using any recreational amenity. Guest agrees to use all recreational amenities only in a safe and responsible manner consistent with all posted rules, this Agreement, and applicable law. Guest and all adult members of the rental party agree to indemnify, defend, and hold harmless LunaSol Vacations and the property owner from and against any and all claims, demands, losses, costs, damages, and liabilities — including reasonable legal fees — arising from Guest's use of any recreational amenity. B. Kayak Use — Rules and Conditions The following applies to properties that provide kayaks or other non-motorized watercraft for Guest use. Personal flotation devices (PFDs) must be worn by all occupants at all times while on the water. Kayaks must be used in designated water areas only and operated in compliance with all local waterway regulations. Kayaks must not be operated in rough water, storm conditions, or after dark. The rated maximum capacity of each kayak must not be exceeded. Kayaks must be returned to the designated storage area, properly secured, after each use. Guests are responsible for any damage to kayaks or equipment beyond normal wear, which will be charged to the credit card on file. Kayaks are provided as-is, and LunaSol Vacations does not guarantee the availability or condition of kayaks at any particular time during the stay. Children must be accompanied by a responsible adult and must wear an appropriately sized PFD at all times. Guest acknowledges that open water activities carry inherent risks including but not limited to drowning, capsizing, injury, and collision with watercraft or other hazards, and assumes all such risks. C. Bicycle Use — Rules and Conditions The following applies to properties that provide bicycles for Guest use. Helmets and any available safety equipment are strongly recommended and must be used by all riders where provided. Helmet use is the sole responsibility of the Guest. Bicycles must be operated in compliance with all applicable traffic laws. Bicycles must not be taken off-property without prior approval from LunaSol Vacations. Bicycles must be returned to the designated storage location at the end of each use and secured with any provided lock. Guest is responsible for any damage to bicycles beyond normal wear and tear, which will be assessed and charged to the credit card on file. Do not attempt repairs or modifications to bicycles; report any mechanical issues to LunaSol Vacations immediately. Bicycles are provided as-is, and LunaSol Vacations makes no guarantee as to bicycle availability or condition throughout the stay. Children under 12 years of age must be supervised by an adult at all times while riding. Guest acknowledges that cycling carries inherent risks including injury from falls, collisions, and road conditions, and assumes all such risks. ACKNOWLEDGMENT By acknowledging this Agreement, Guest confirms that they have read and fully understand all terms and conditions of this Vacation Rental Agreement, including the Recreational Amenities Waiver and Release of Liability set forth in Section 16. Guest agrees to be bound by all provisions hereof and authorizes LunaSol Vacations to charge the credit card on file for all amounts due under this Agreement, including but not limited to the rental balance, applicable taxes, the $75.00 non-refundable damage waiver fee, and any additional authorized charges for damages, excessive cleaning, unauthorized pets, smoking violations, or recreational amenity violations.
